Terms & Conditions

We are rewriting our terms for long-term rentals off campus. This version is being reviewed and does not yet apply. Ask us on WhatsApp if anything here matters to your rental and we'll tell you exactly what applies today.

These terms apply when you rent a surfboard, stand-up paddle board, surfskate or wetsuit from Ohana Rentals. Renting from us means you accept them.

1. Who can rent

  • You must be 18 or older. Under 18, a parent or guardian rents on your behalf and carries the responsibility.
  • You do not need to be a student. Students get a discounted rate and show us a student email or card when we meet.
  • The gear is for you. Lending it on to someone else is not allowed — see section 7.

2. How a rental comes about

The form on our site sends us a request, not a booking. Nothing is reserved and nothing is owed yet. We reply on WhatsApp, confirm what is actually available and agree the final price with you. The rental starts when we hand the gear over.

The price shown on the site is a guide based on the duration and options you picked. If we agree something different with you — another board, a different period, a longer rental — the price we agree on WhatsApp is the one that counts.

3. Duration, extension and early return

  • The minimum rental is two weeks. Beyond that you choose the period, and the longer you keep the gear the lower the weekly rate.
  • Want to keep it longer? Tell us before the end date and we will extend it at the rate for the new total duration.
  • Bringing it back early is fine, but the agreed period has been booked and is not refunded.
  • Keeping the gear past the agreed end date without arranging an extension is charged at our standard weekly rate, and we may ask for it back at any time.

4. Payment

  • You pay in person when we hand the gear over — cash, PayPal or Revolut.
  • We take no deposit and we never ask for card details. Nobody from Ohana will ever ask you for a card number, a PIN or a password.
  • Damage, if any, is settled when you hand the gear back.

5. Handover and swaps

We keep boards in Carcavelos and in Lisbon and arrange handover with you on WhatsApp. We check the gear together and photograph it at handover and at return — that record protects both of us.

You can swap to a different board during your rental if something else suits you better. Just ask. We cannot guarantee a particular board will be free.

6. Looking after the gear

  • Keep it at home, treat it as your own.
  • Rinse boards and wetsuits with fresh water after use.
  • Never wax a soft top.
  • Do not repair damage yourself.
  • Report any damage the same day, with a photo, on WhatsApp.

Damage and loss are charged at the fixed prices in our Damage Policy, which forms part of these terms. Optional Damage Cover caps what you pay for accidental damage at 25 €.

7. Surfing is dangerous — and you are on your own out there

Surfing carries real risk of injury and death: drowning, collisions with other surfers or with your own board, rip currents, shifting conditions, marine life, and equipment that can fail. By renting from us you accept those risks.

Nobody from Ohana is with you in the water. We do not supervise, teach, patrol or rescue. You are responsible for your own safety, for judging whether the conditions suit your level, and for any costs of rescue or medical treatment.

By renting you confirm that:

  • you can swim and are physically fit to surf;
  • you know basic surf etiquette and right of way;
  • you will not surf under the influence of alcohol or drugs;
  • you have no medical condition that makes surfing unsafe for you or others.

We carry no insurance for your injuries or your belongings. Arranging your own health, accident and liability cover is your decision and your responsibility.

You release Ohana from claims arising from your use of the gear, and you cover us against claims from third parties you injure or whose property you damage. This release covers ordinary negligence only. It does not — and legally cannot — cover gross negligence, intent, or injury to life, body or health caused by us.

8. When we can end the rental

We can end a rental immediately and ask for the gear back if you lend it to someone else, surf under the influence, refuse to pay for damage, or repeatedly ignore these terms. In that case the paid period is not refunded.

We may also decline a request or stop renting for safety or operational reasons. If we cut short a rental for a reason that is on our side, you get the unused part back.

9. Your right to cancel

As a consumer in the EU you generally have 14 days to withdraw from a contract concluded at a distance. Because we agree the rental with you personally and hand the gear over in person, you can cancel free of charge at any time before handover — just tell us. Once you have the gear, section 3 applies.

10. Changes to these terms

We may update these terms. The version that applies to your rental is the one in force when we hand the gear over, and we will not change the terms of a rental that is already running.

11. Complaints and disputes

Talk to us first — most things are sorted in one message. Portuguese consumers can also use the official complaints book (Livro de Reclamações) at livroreclamacoes.pt, and the EU online dispute resolution platform at ec.europa.eu/consumers/odr.

Portuguese law applies and the courts of Lisbon have jurisdiction. If any clause turns out to be invalid, the rest stays in force.
